REFERENCE:

NRC Letter dated September 2, 1983

Dear Mr. Collins:

This letter is in response to the Notice of Violation received as a result of inspections conducted at Fort St. Vrain during the period June 13-17, 1983.

The following response to the items contained in the Notice of Violation is hereby submitted:

In 10CFR73.55(d) it states, in part, "... The search function for detection of firearms, explosives, and incendiary devices shall be conducted either by a physical search or by use of equipment capable of detecting such devices...."

The Fort St.

Vrain Unit No. 1 Amended Security Plan dated October 31, 1977, Section 3.2.1.5, states The performance objective for both the metal detection and the X-ray search device is to detect weapons on individuals, in packages, or in hand carried parcels.

In addition to the detectors, a random " hands-on" search may be conducted before admittance.

The frequency of random searches is nominally 5'4 with both detectors in operation,..

- The Fort St. Vrain Unit No. 1 Security Instructions, Revision 8, dated December 8, 1980, Section 11.2.1 states, in part, "With all search equipment (metal detector and explosive detector) operational, a 5% hands-on search of all nonregular personnel only shall be conducted. Nonregular personnel are distinguished by a pink dot on the identification badge...

The proper percentage of hands on searches is determined by use of clear and colored marbles contained in a specially constructed box..

Each person of the applicable group shall be shown and adviseJ ef the results of the random selection by the Search and Escort Guarc."

Contrary to the above, on May 19, 1983, an NRC Reactor Inspector passed beyend the Search and Escort Guard without being shown and advised of the results of the random selection determined by a clear or colored marble.

The NRC Reactor Inspector was wearing a NRC hardhat and had a Fort St. Vrain identification badge with a pink dot on the I.D. badge.

The NRC Reactor Inspector, after observing that the guard had failed to show and advise him of the random selection asked the Search and Escort Guard to pull a marble. The Search and Escort Guard replied that the NRC Reactor Inspector should pull the marble.

The NRC Inspector reported this violation to the Fort St. Vrain Security Supervisor.

This violation is identified in NRC Inspection Report 50-267/83-12 as security violation 8312-05.

This is a Severity Level V Violation (Supplement III).

(1) The corrective steps which have been taken and the results achieved:

All appropriate guard force personnel have been apprised of the situation and retraining of these personnel has resulted in an

-increased awareness of the non-regular employees search status.

The original concept of the non-regular search as described in the Security Instructions remains valid and consistent.

It is not now, nor has it ever been policy for non-Security personnel to have access to the Random Selection Device (marble box).

Investigation with personnel involved revealed that there was never any intention to indicate the inspector was responsible for the search selection process.

It appears that the reference to the guard stating the inspector should pull the marble was a misunderstanding of requests made of the inspector.

.. ~ (2) Corrective steps which wi'l be taken to avoid further

violations:

Continued training, retraining, internal audits and controlled tests will be maintained with appropriate personnel.

Security management at FSV does not recominend any physical changes in the system at this time.

(3) The date when full compliance will be achieved:

Fort St. Vrain is in fu'il compliance at this time.
