Under 10 C.F.R. 150.47 (1), an Operating License may not be issued without a finding by this Bs ard that " construction of the facility has been substantially completec in conformity with the construction permit and t he appl i ca t ion as ames. 'ad, the provisions of the Act and the rules and regula'tions of the Commission..."
The Seabrook Ownership Group has brought construction of Un'it 11 to a near standstill, and has deferred further significant cons t ruc t ion e f f or t s unt il complet ion of Uni t 1.

The consequence of this decision is that the Applicant's est imated complet ion date for Uni t II, f ormer ly J u ly, 1987, has been abandoned.
Presently, Unit 11 has no estimated completion date.
Assuming Un'it 1 is opera t iona l by December, 1984, as pro j ec ted by Applican t s,
Unit iI ril1 not be completed unti1 May, 1989.

Overwhe lmi ng ev idence i nd ien t es, however, t ha t bo th t he December 1984 date for Unit'1, and the f ormer Ju ly, 11187 date for Unit 11 are grossly optimistic.
That the Uni t I estimate is inaccurate is borne out by a recent Staff-analysis of Applicant's construction progress.
In a recent letter from Darrell G..Eisenhut, Director, Division of Licensing, Office of. Nuclear Reactor. Regulation, to PSNll P res ident Robert liar r i son, the Staff's conclusion.was that Onit I would not be ready
.for fuel loading until the first_ quarter of 1986.

Although the Applicant has continually asserted a mere three month lendtime between fuel load and commercial operation, the New Hampshire Public Utilities Commission found this assumption to be entirely unrealistic.
Based upon the evidence in this docket, the Commission finds -that there is substantial probabili ty that the time f rame between the fuel load da te and the commercial operat ion date f or Seabrook Unit I and Unit II will be between 6 months and 11 1/2 months.
For purposes of p!'anning the Commission finds that the most likely t ime period wi thin this range is 8 months.

Therefore using the Staff's fuel loading estimate and the New Hampsh i re PUC's opera t ion lead t ime, Uni t I wi ll not be in commercial operation untiI the fourth quarter of 1986.
Independent of f urther slippage in the Applicant's projected time required for Unit 11 completion, this would bring Unit 11 on line in the second quarter of 1989.
Even t hi s assumpt ion i s op t imi s t ic.
Af ter an exhaus t ive review o f App l i can t 's comp le t ion es t ima t es, t he New Ilumpsh i re PUC a lso f ound t he f o rme r J u lv ',19 8 7 da t e fo r Un i.t II -to be en t i rely unsubs tant ia ted.
The Commission concluded that the most likely completion date for

Scabrook Unit I1 as_of'Apri1,'1983 was b rch, 1990.
There-is no reason to doubt the validity of the New Ilampshire PUC conclusions.
Its estimate of W rch, 1986 as a completion date for Unit 1,
for example, is the same as that projected by NRC Staff in its own independent evaluation.
Assuming the accuracy of both Staffrund_PUC findings, it is even if construction resumes its April, 1983 schedule likely,that after completion of Unit 1,
Unit 11 will not be operational until September of 1993.
CONCLUSION.
The language of 10 C.F.R. }50.47 (1) is eleur.
The finding by this Board that construction of Seabrook Unit 11 has been "substantially" completed is an absolute prerequisite to issuance of.an Operating License.
The finding is also mandatory regardless of the scope of contentions admitted for adjudication in these proceedings.- (Ci t a t i on)
At present, Unit 11 cons t ruct ion has been essent ially hal ted at l
.a completion 1 eve 1 of only 23.4%.
Even assuming that the uti1ity is able to resume fulI construction on erarse with Staff and New l
llampshire PUC estimates, it wilI not be completed unti1 10 years from now.
SAPL asser t s that the language of 50.47 (1) i s plain, and that there is-no way in which this Board can make a finding of " substantial completion" in light of these delays.

a Atomic Saf ety & Licensing Board has ever issued an Operating License to a plant only 23.4% complete.
For the reasons set forth in this Motion, SAPL moves that the applicat ion f or Uni t 11 Opera t ing License, Docket 50-44 4 be di smi ssed as untimely.
