Dear Mr. Chairman:
At the Subcommittee's February 22 hearing on the Commission's FY 1984 and 1985 authorization legislation, I said it was important to determine whether the GPU v. B&W trial record contains information bearing on the question of GPU's meeting the competence and character requirements of a holder of a reactor operating License.
I reiterated this concern in a February 22 letter.
In the Commission's June 1 response to my letter, Acting Chairman Ahearne stated that the Commission shared my view that the Babcock and Wilcox (B&W) General Public Utilities (GPU) litigation be carefully reviewed as expressed in your February 25, 1983 letter..."
I have been informed that at a Commission-meeting on June 21 the Commissioners and staff engaged in discussion as to whether the trial record contained information that would affect the Commission's determination on the question of GPU l
management integrity.
While I am making no judgement as to the outcome of a review of the trial record, I have been told by my staff that the. record does contain significant information bearing on the following questions that relate l
to the integrity issue:

- Did GPU fulfill its obligation to provide the NRC l
documents, including analyses of the accident, pertaining to competence and integrity of pre-accident management?
- Did GPU fulfill its obligation to inquire into allegations of willful violations of the Commission's regulations, to take action against persons who might have so violated the regulations, and to report fully to the Commission on such inquiries and actions?'

., - Did GPU fulfill its obligation to be fully forthcoming,in its responses to NRC requests for information pertaining to the accident and its underlying causes?
- Did GPU withhold from the Commission information that might have jeopatlized its position in litigation of its claims against B&W and the United States?
In view of the existence of diverse views on the nature of the integrity issue and the manner in which it should be addressed, I am writing to enumerate questions that I believe need to be examined in order to resolve the matter.
