Dear Mark:
This is in response to your request that arose out of our telephone conference of yesterday in which we (NRC, LEA, PECO, City) resolved all of the other scheduling matters for environmental qualification of equipment and systems interaction. You asked that I put in writing my statement that the City would be unable to respond in the normal time frame to your-interrogatories that were received on Monday of this week (February 6, 1984).

Our expert received the requests on February 7, 1984.
For the remainder of this week he will be assisting the City in preparing its DES filing, which is due Tuesday, February 14, 1984.
However,.on February, 10, 1984 he is leaving the country to testify in another proceeding.
He will not be back in his office until February 27, 1984.
I had requested your agreement that we provide these answers on March 15, 1984.
That gives the City eighteen days to respond starting from February 27, 1984.
Even if you counted the days during which we will be preparing the DF.S filing, the total response preparation time the City will have, exclusive of the period during which the expert is out of the country, is twenty-one days.
That is consistent with the October 28, 1983 Order allowance of 20 days plus 5 (regular mail) or 2 (express mail).
(Although you conveyed via Federal Express your sending date was a Friday; therefore we didn't receive it until a Monday, the third, not first day af ter issuanceJ To conclude, this is to formally request the_ Company's agreement with this schedule.
