16) and "4. Construction" (bottom of page 16 through page 19 and Attachment D thereto), and in support thereof states as follows:

"3. Aggressive Behavior" (pages 15-16):

of New York State's testimony describes incidents of aggressive behavior by paying spectators at the 1980 Lake Placid Olympics, directed toward personnel from the New York Department of Transportation who were attempting to aid with transportation planning, particularly with direction of buses ferrying specta-tors between satellite parking lots and competition areas.

i and all paying spectators arriving by automobile were required to park in these satellite areas, located 1 to 8 miles from the village and competition areas, and to be transported by bus from there.

A shortage of buses resulted in hours-long waits in the cold and snow for these would-be spectators in satellite lots.

This situation prevailed until the fifth day of the Olympics, when Governor Carey declared a limited state of emer-gency and made State resources available to manage the traffic problems.

State employees directed traffic in parking lots, organized bus queues and performed other functions.

Some of them, apparently, were recipients of hostility from some, though not all, of the would-be spectators.

These facts, de-scribed in more detail in Supplemental Testimony of Matthew C.

Lieberman and Dennis S.

Mileti on Behalf of Long Island Lightir g Company in Response to New York State Tcstimony on Phase II Emergency Planning Conten-tion 65, are based upon the depositions of New York State wit-nesses on February 1, 1984 and contemporary newspaper accounts, and are believed to be consistent with New York State's prefiled testimony on this subject.

New York State's testimony on aggressive behavior was pre-pared by Messrs. Albertin and Knighton, who were present at Lake Placid (State Deposition Tr. at 113).

This testimony is not relevant on its face to an evacuation undertaken as a pro-tective measure following a nuclear power plant accident at Shoreham.

The circumstances of Lake Placid -- voluntary, paying customers (holding tickets priced up to $30 to $60 face t

- value) reacting in frustration to hours-long waits in the snow and cold for buses to ferry them to and from spectator events

-- are different enough from those of a nuclear accident that, absent a qualified basis to demonstrate that they are probative of the likelihood of aggressive behavior directed toward-traffic guides and others in an evacuation following a nuclear accident at Shoreham, they do not meet the standard for admis-sibility set forth in 5 2.743(c) of the commission's Rules of Practice, which restricts evidence to " relevant, material and reliable evidence."

Messrs. Albertin and Knighton are not qualified by educa-tion, training or experience to sponsor as experts, the profes-sional opinion proffered in their testimony (page 16, fourth paragraph) that " behavior (similar to that at Lake Placid] is likely during the stressful conditions of an emergency at Shoreham."

Mr. Albertin, according to his curriculum vitae (Attachment 1), holds degrees in civil engineering and trans-portation engineering.

Ever since his graduation from college in 1970 he has worked as a transportation analyst, at one level or another, for the New York State Department of Transporta-tion.

His resume shows no significant education, training or experience in behavioral sciences.

His resume indicates that his duties have included reviews of nuclear power plant emer-gency plans, but that they were limited to transportation ele-ments of such plans.

He is not qualified as an expert to ren-der testimony on the_ likelihood of occurrence of aggressive behavior during a ple.nned evacuation following a nuclear. plant accident.

Mr. Knighton is similarly unqualified to render an expert opinion on the likelihood of aggressive behavior during a planned evacuation following a nuclear power plant accident.

According to his resume (Attachment 2), he received a.5 ache-lor's degree in economics; his resume shows some engineering academic background but nothing in the behavioral sciences.

His professional career has involved service as an income tax examiner and, in recent years, as a transportation analyst for the NYSDOT.

There is no evidence of education, training or ex-perience which would qualify him to render an expert opinion on the likelihood of occurrence of aggressive behavior, in the event of an evacuation following an accident at a nuclear power i

plant.

l Thus there is no qualified basis for the opinion, at the bottom of page 16, that aggressive behavior toward LILCO's traffic guides "similar" to that at Lake Placid can be expect-ed.

Absent proper support for that opinion, there is no rele-vance to the implicit criticism in the following sentence on page 16 of LILCO's not having factored the effects of such be-havior into its evacuation time estimates.

Absent such sup-port, also, there is no relevance to the description of the very different circumstances of Lake Placid.

Messrs. Albertin and Knighton are not qualified to offer a professional opinion on the likelihood of aggressive behavior toward traffic guides in the event of an accident at Shoreham, and their status as eyewitnesses to and participants in the Lake Placid fiasco does not change that fact.

This portion of

l New York State's testimony should be struck as lacking any ex-pert basis and as being, therefore, unreliable and irrelevant.

"4. Construction" (page 16-19 and Attachment D):

LILCO moves to strike this testimony on the ground that it merely resubmits, in a slightly different guise, testimony originally proffered by Suffolk County and stricken by this Board as being untimely.

(Tr. 2396-2403 (January 18, 1984)).

New York State's testimony on highway construction recites var-ious road construction projects scheduled in Suffolk County be-tween 1984 and 1989, and recommends that LILCO conduct sensi-tivity runs to determine their effect.

The testimony asserts that scheduled road construction projects in and in the vicini-ty of the Shoreham EPZ are numerous enough that they should be factored into evacuation time estimates.

That assertion is documented in Attachment D to New York State's testimony, which is a compilation entitled " Projects in December 7, 1983 Trans-portation Improvement Program."

Attachment D, as was established in the depositions of New York State's witnesses, merely summarizes material in an annu-ally updated report, most recently issued on December 7, 1983 and entitled "Nassau-Suffolk Transportation Improvement Pro-gram, State Fiscal Years 1984-89."

(Deposition Tr. 132-33).

Examination of this latter document reveals that it contains tables of various categories of highway construction and repair programs, listed by year for the period 1984-89.

These pages are identical to the corresponding pages appended as Attachment 11 to the January 18, 1984 " Amended Direct Testimony of

Inspector Richard C. Roberts [et al.)," and are attached hereto (Attachment 3) for comparative purposes.

, Attachment 11 to the Suffolk County testimony and the cor-responding text on page 61 were struck by this Board on January 18, 1984 as being inexcusably untimely since the argument could have been, but was not, raised earlier by Suffolk County.

One of the points made in that argument (Tr. 2401) was that the computer listing relied on for the proposition that roadway construction takes place is an annual one, and thus the 1982 report would have been available to Suffolk County; this point was corroborated in the deposition of the State's witnesses (Deposition Tr. 132-33).

New York State's testimony on highway construction is based on the same document that this Board has already ruled was untimely used by Suffolk County.

What was untimely for the County cannot become somehow timely a month later when used by New York State.

The State may have only recently become an ac-tive party, but the timing of its decision does not exempt it as a legal party already for several years, from the previous rulings of this Board or from notions of common fairness.

If New York State is allowed to play tag-team tactics with suffolk County it will subvert any notion of order and fairness in this proceeding.

The State's testimony on item "4.

Construction" should be struck, along with Attachment D to it.

This portion of the State's testimony should be struck for another reason as well:

the deposition testimony ~of the wit-ness sponsoring it, Mr. Foster Beach, reveals such uncertainty

  • in the actual dates of even presently scheduled highway proj-ects, more than a year or two out, that it fundamentally com-promisss the testimony's assertions (Testimony at 18-19) that published construction project date estimates are sufficiently certain and reliable to justify preparation of sensitivity analyses based on them.

(See Deposition Tr. 134-39, 144-45, especially 136, 145) (Attachment 4).

Thus the testimony has been sufficiently compromised by its own sponsor as to not be probative.

$1.5 million in private funds for upstate transit operators.

.sioner Gennessy and George Driggs, Head of the DOT Olympic Task Force.

Senior Transportation Analyst Small Urban / Rural County Transportation Study Unit - January 1977 to October 1979 This Unit has responsibility for transportation planning in non-metropolitan areas of New York State. Special emphasis is placed on planning for needed transit service and on providing improved transportation service for transportation disadvantaged groups.

j Development of innovative transit and paratransit alternatives and improvement of den.and and cost estimating techniques is also included.

l In addition to rural transit planning, the Unit is responsible for analysis of highway conditions in thirty-eight rural counties not included in 3C Planning Process.

Some specific activities include:

. Direction of the Sullivan County Rural Public Transportation Study which con-ducted a thorough analysis of transportation needs. The study resulted in county support for a federal (UNIA) capital grant to support an existing oper-ator, and provided longer tena recommendations for additional services. Respon-sibilities included planning and conducting public meetings, conducting various surveys and preparing written documentation.

. Provide direct technical support to Otsego County Planning Staff in conducting a public transportation needs study including planning and conducting a cosmiunity interest survey.

. Preparation of working papers on objectives of Rural Public Transportation, Comparative Service Measures for Rural Transit and Financing Rural Public Transportation.

. Developed a technique for estimating rural transit ridership which was sensitive to levels of service provided (see publication list, TRR 718).

Research Analyst (Transportation) - June 1975 to January 1977 Planning Research Unit I

i The Planning Research Unit is responsible for a wide range of research for transportation planning including public transit, demand modeling and economic forecasting. Some specific projects include:

. Preparation of a report reviewing and suusarizing procedures used by the New York. State Department of Transportation and others in the state for projecting population, income, employment, auto ownership and trip-saking.

This report was used'as a background for a review of forecasting as a function of the Planning and Research Bureau (see publication list, PRR 102).

. Work on Transportation Planning for the 1980 Winter Olympics at Lake Placid.

This included estimation of travel demand within the Olympic area and analysis of alternative ways to meet that demand. A hypothetical system was designed to demonstrate the feasibility of using buses and to estimate the number of buses necessary. This included estimation of bus headways, analysis of space and time required to load and unload buses, analysis of the effect of heavy bus concentrations on highway capacity and estimation of highway passenger carrying capacity with various bus concentration (see publications list, PRR 100. TRR 625).

. Develop a refined 'non-commitment' procedure for estimating demand for dial-a-bus service in small urban areas. Development involved detailed analysis of public opinion and on-board bus surveys conducted in areas with existing service (see publications list, PRR 104).

. Analyzed the impact of various barriers on the use of public transportation by, elderly and handicapped individuals. This resulted in development of a procedure for estimating the effect of barrier removal on transit ridership (see publications list TRR 660).

6 Research Analyst (Transportation)

Until its combination with the Planning Research Unit in June 1975, the Forecasting i

Unit was responsible for preparation of long range economic forecasts for regions cnd subareas (traffic analysis zones and. minor civil dividions). Some projects include:

. Work on the first annual Transportation Operating Assistance Evaluation i

Report. Particularly, a detailed analysis of transit operating cost j

components, including projections of cost increases for salary, main-q

tenance, fuel and retirement benefits. A transit operating cost index was developed from this analysis and has been used in estimating transit

,j subsidy needs for the future (see publications list TRR 626, PRR 92).

. Assist in preparing statewide forecasts of transit ridership and deficit (i

including preparation of estimates of input parameters.

. Prepare estimates of population, auto ownership, income and employment for several upstate urban areas. The forecasts were used to update mode split and transit O&D estimates using the Department's computer simulation package. This effort included preparation of the Capital District Economic report.

Tax Examiner New York State Income Tax Bureau - February 1971 to February 1973 As a tax examiner, my primary responsibility was the audit of individual income tax returns. From February through April. I supervised a unit of twenty-two people, including sixteen tenporary clerks and six other tax examiners. I was. responsible for assignment and flow of work, quality control, training of clerks, timekeeping and parsonal matters for the Unit.

Yes, for '84 '85.

Most of 18 our programs are_ federally funded.

19 We get that on a five-year allocation.-

20 Our funding is guaranteed for 91ve years.

e 21 One hundred percent state funded jobs are 22 on a program for two years in advance.

With the recent 23 passage of the bond issue, we are assured of active 24 25

I am fairly confident of the 6

aware of that could cause the project to slip.

I would say the process has 6

been around since 1973.

Has your assessment of--has the confidence that you have in scheduling projects for a

9 the next five years--that projects will be undertaken within a couple of months of the time printed in the 10 11 schedule, has that been uniformly the case with projects 12 which were undertaken since, say, this system came into 13 effect in the early 1970's?

14 MR. BEACH:

That is hard to say.

I have 15 been in this position three years this July.

16 knoW the track record as well, perhaps, in Nassau and 17

,Suffolk.

l 18 It has been my experience that once a 19 project is on here and the support continues from the 20 local level, that project will be implemented.

o 21 As I said earlier, a lot of times 22 controversy or environmental studies may delay a project,.but it will eventually be implemented.

What happens when the 16 estimated cost of a project changes between publication 17 now and the date of commencement?

Several things can take place.

19 First of all, depends on the particular 20 category of funds or funds source as to what would o

21 happen.

22 In many cases, we may move projects 23 around because of shortage of funds for a particular 24 25

project that might have more support.

That is a 3

possibility.

4 Another possibility. i f we have a project 1

5 that is ready to go to letting and cost has gone up, we 6

may let it.

Money may be borrowed from someplace else 7

in the state.

8 On occasion, if we see that a project is I

9 ready to go to letting and cost has gone up, we might 10 incur a savings from another job in the same funding 11 category we can apply to that.

No, not necessarily.

Depends to on the need of the project or the deficiency you are 17 trying to correct.

I would like to clarify, our 3

reconditioning and preservation program, a one hundred 4

percent State program, which was based on an annual 5

allocation frca the legislature passed and allocated 6

April lat.

7 We normally only program that one or two 8

years ahead because each year's allocation is based on 9

action by the legislature.

10 MR. PALOMINO:

When you were talking 11 about the uncertainty of projects and shifting around 12 and borrowing and so forth, curtailing of projects, does l

I 13 that apply to the two-year projects?

14 MR. BEACH:

It can, depending on what the is estimate of the bid that comes in at the time of to contract letting is.

17 However, the ones that are more closely la ready to be let, we find ways of coming up with the 19 funds to insure they do go to contract after being let.

20 Where projects have a tendency to slip, o

21 those that are three, four or five years,-further out, I

22 where there may be more events or things that might 23 occur that could delay a project.
