APPLICATION FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By letter dated September 14, 1983, you submitted the " Assessment of TMI-l Plant Safety for Return to Service Af ter Steam Generator Repair", Topical Report 008, Revision 3.
You have requested that the infomation in certain sections and figures of the report be withheld from public disclosure pursuant to 10 CFR Section 2.790.
The withholding request is supported by affidavit signed by Mr. James H. Taylor of B&W dated March 7,1983.
Your requests to withhold earlier revisions of this report from public inspection were previously granted by HRC letter dated August 9,1983.
B&W maintains that the document contains infomation of the type customarily held in confidence by them and that such infomation is not available in open literature and is not known by potential competitors of B&W.
B&W believes that disclosure of this infomation would reduce the expenditure l
of their competitors and, tous, would harm their competitive position.
We have reviewed the application and related material based on the require-ments and criteria of 10 CFR 2.790 and have detemined that this report contains proprietary commercial infomation.
We have also found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of 94W's competitive position. Accordingly, we have detemined that the applicable information should be withheld fran public disclosure.
We, therefore, approve the request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding from public inspection the above mentioned document.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document. If the need arises, we may send copies of this infomation te our consult-ants working in this area. We will, of course, assure that the consult-ants have signed the appropriate agresu nts for handling proprietary data.
