Re: CBG's August 26, 1983 Document

Dear Administrative Judges:

In the document CBG filed on August 26, 1983, CBG moved to

. strike a response of Dr. Harry Pearlman appearing at page 1870 of the transcript. CBG cited the same page of the transcript in arguing that the Board said that it would permit such a motion to be filed after the hearing.

In fact, CBG has misrepresented the Board's ruling on this

' matter. The Board overruled CBG's motion to strike, after CBG insisted it needed a ruling before it could proceed, and instead agreed to recall Dr. Pearlman in October after CBG had time to review Dr. Pearlman's calculations (Tr. 1871-72). CBG has advised the Board that recalling Dr. Pearlman will be unsatisfactory but has offered no explanation why. Under the circumstances, the

-relief requested by CBG is inappropriate. In the event that the Board, on its own motion, decides to reconsider its earlier ruling, University will request an opportunity to respond.
