- Station, Gentlemen:
During the February 3 conference call, the parties informed Chairman Wolfe of a Joint Stipulation concerning the Intervenors' contention on the City of Waverly.
In sum, the stipulation pro-vides that Waverly will be added to the plume exposure pathway EPZ and that specified commitments of planning, equipment and personnel will be made to accommodate this' expansion.
In turn, the Inter-venors will withdraw their Waverly contention and will not litigate the availability or adequacy of resources and personnel to provide for emergency response activities with respect to Waverly.
Intervenors also agree that their remaining contentions are not to be interpreted to raise issues concerning how adding Waverly to the EPZ would affect emergency response activities for the current EPZ (i.e.,
the EPZ without Waverly).
Enclosed is a copy of the Joint Stipulation signed by Counsel for Applicants and Intervenors.
