Docket No. 50-322-OL-3 (Emergency Planning Proceedings)
Sirs:
North Shore Committee supports Suffolk's County objections to the schedule in the Board's Special Prehearing Conference Order, dated August 19, 1983.
We do not repeat the cogent and compelling arguments advanced by Suffolk County in its August 23, 1983 pleading.
NSC adopts them in full.
We especially direct the Board's attention to the August 22, 1983 communication from LILCO's counsel to the Brenner Board, attached hereto, that LILCO now believes that, at best, fuel load can occur at some point during the first quarte of 1984." (emphasis added).
If to that is added current reports of faults and failures in the other generator (s), by no stretch of the imagination can the County's suggested schedule delay the opening of the plant.
One additional factor, however, is peculiar to NSC and perhaps SOC and the Town of Southampton.
Unlike Suffolk County and LILCO, NSC has but one attorney to deal with all aspects of this litigation.
The deposition schedule in the Order may make it impossible for counsel to participate in all the depositions kDR D

Page Two August 26, 1983 involving the contentions in which NSC is interested.
Compression of depositions and other discovery in the schedule set forth in the Order is so extreme that NSC and other intervenors who may be similarly situated will be deprived of their due process right effectively to litigate the unprecedented issues in this pro-ceeding.
NSC therefore urges the Board to grant the relief requested
.by the County in its pleading (pp. 8-9).

Docket No. 50-322 (OL)
Gentlemen:
In light of the diesel generator situation, LILCO now belfoves that, at best, fuel loac can occur at some point dur-ing the first quarter of 1984.
The Company today notified the NRC Staff that prelimi-nary indications have been found of a possible fault on the crankshaft of a second diesel.
Further details, if any are available, will be provided the Board in LILCO's August 25th status report.
