Dear Mr. Dircks,
I have received your letter of August 22, 1983, responding to mine of August 11.
Thank you for your quick response.
You note that Commissioner Gilinsky's question assumed, not that the staff " knew" that the leak rates had been falsified, but " believed" that they "had likely been falsified."
You claim that this is a " critical" difference and that my letter requires no further response because it is " predicated" on this
" misunderstanding."
I consider this response to be an evasion of my comments.
Let us accept your phraseology for purposes of argument and assume that the staff believed it "likely" that the leak rates had been f alsified (even though Tim Martin did not so delicately qualify his statements at the Commission briefing in May).
The fact still remains that the question you were asked is why the staff failed to communciate this belief (and, I would add, the supporting evidence) to the ASLB.
And on this point, all of my letter to you remains entirely valid.
I will sum it up once again: not only did the NRC staff fail to affirmatively communicate its belief that leak rates "had likely been f alsified" to the ASLB, it communicated precisely the. opposite impression and misled the Board and the parties.
The quotations from the relevant staff documents, which I included-in their entirety in my letter of August 11, 1983, f ully bear this out.
My letter to you was for the purpose of directing your personal attention to'these facts because of your role as overall supervisor of the NRC Staff.
It occurred to me.that you had perhaps never read the pertinent sections of the SER,
- so I included them.
