@fy fifteen meetings which you identified as responsive to the request, you withheld transcripts of Nos. 1 through 4, 9 and 11 through 14 o,4 in their entirety under Exemptions 5 and 10 of the Government in the Sunshine Act.

You further withheld transcripts 7, S, and 10,

Dear Mr. Detjen:

This i[ in final response to your June 8,1983 letter in which you 1

recuestec, pursuant tc tne Freedom of Jnformation Act, copies of the i

transcripts of all closed Comission meetings held between August 27, 1951 and May 10, 1983 at which the Comissioners discussed the restart of Three Mile Island, Unit 1 (TMI-1).

We have identified 15 meetings responsive to your reouest.

These meetings are listed on Attachment A, and will be referred to in this letter by the-number designation given in Attachment A.

Transcript 5 is being released in its entirety as a matter of discretion.

Transcripts 1 througn 4, 9, and 11 through 14 are being withheld in 9 -n e their entirety under Exemptions 5 and 10 of the Government in the 4 ' ~ r Sunshine Act.'

The discussions in these transcripts deal primarily with

the Qoestion of whether a decision in an enforcement proceeding authorizing restart of TMI-l reached by an Atomic Safety and Licensing Board following a formal adjudicatory proceeding should become immediately effective during the pe'ndency of the appeilate process within the Comission.

These discussions inciuce what issues should be included in a restart decision, the language of such a decision and procedural and scheduling matters in the adjudication.

All of these matters involve conduct or disposition of a particular case of formal agency adjucication and are thus withnoloable under Exemption 10 of the Government in the Sunshine Act, 5 U.S.C. 552b(c)(10) and the Cor.-issior.'s reguiations.10 CFR 9.104a)'iO).
