Dear Administrative Judges:
We are in receipt of letters from Mr. Bordenick and Mr. Lanpher concerning apparent inconsistencies in Mr. Hubbard's testimony in this proceeding and Diablo Canyon.
Only the Board knows whether it may or will rely in important ways on certain statements in the record.
Therefore, we believe Mr. Bordenick's prompt disclosure to the Board was appropriate in light of all the circumstances.
It is well-established that licensing boards are to be informed of any development that may bear on their decision.
It is for each individual licensing board to determine whether the information warrants further attention.
Thus, Mr. Bordenick's disclosure was wholly consistent with proper practice in this and other proceedings.
