Dear Mr. Cormier:

By letter dated October 7,1983, Commissioner Gilinsky wrote to the Director of the Nuclear Energy Iab at UCIA (with copy to Chancellor Young) regarding UCLA's views about converting it s reactor to Icw Enriched

Uranium fuel. He also provided a copy of a report on the subject,

! containing information provided by Mr. Ostrander.

Commissioner Gilinsky's letter was served by Docketing on the parties to this proceeding, but as yet we have not received a copy of any response from UCIA to Commissioner Gilinsky. We would appreciate it if you would check to see if the NEL Director, the Chanceller, or other UCIA representative has communicated with Commissioner Gilinsky on this subject, and, if so, provide the parties with copies.

In a similar vein, we note that Mr. Ostrander submitted on UCIA's behalf a sub-report to the report to the Commissioners by the LEU Study Group. The UCIA sub-report deals with prospects of converting the UCIA Argonaut to LEU and, additionally, makes certain comments about Intervenor's contentions in this proceeding. We were not provided a copy of Mr. Ostrander's i subreport, dated September 7, by UCLA we only became aware of it recently when Staff, responding to a Board inquiry on the IEU issue, provided the full report to the Board. We would appreciate you reviewing your procedtr es

  • for serving such written communication on the parties.

On a somewhat related issue, in April of last year the Board i requested that you provide them and the parties with graphics and other visuals about the core internals. In our recent review of such material at C L, we noted a number of photographs of the core internals that have not yet been provided to the Board. At CBG's request,11 of these photos were reproduced for

its use, but the Board and other parties have not yet been provided copies.

We request, in keeping with the Board's April request for such material,

that you provide the Board and other parties with copies of said photos, at +

your cost. We don't quite understand why they were not provided when the Board first requested them nine months ago, but they should be provided now as they are essential to a determination of the shutdown and related issues still pending.

Additionally. we have not yet received the itemized bill for the materials provided, after considerable delay, last month. We were informed b;' Mr. Ashbaugh at the time that the amount we were asked to pay would be itemized fully; we paid, in order to avoid further delay, reserving right to effect appropriate adjustment once the itemized bill was provided. Furthermore, the negatives for the photographs have not yet been provided, although we were informed we were being charged

$5 per photograph to have negatives produced. Please immediately provide the itemized bill and the negatives.

I understand you wished further itemization of the duplicating costs for the video tape. Please find ssid itemization enclosed. We have yet to receive reimbursement. 7

I have enclosed a copy of a brief report prepared by Dr. Gerald Pollack of Michigan State University on the subject of conversion of university research reactors from high-enriched uranium to lower enrichment. It includes information which Dr. Ostrander supplied on your reactor.

As I shall be using this report as a basis for further action, I would welcome your comments and suggestions.

Doicstic and international security concerns dictate very strongly'that we halt the use of research reactor fuels

! which contain highly enriched uranium because of its nuclear explosive properties. Universities, especially, should make every effort to shift away from nuclear explosive fuels.

This will help prevent the intrusion into research activities of further protective and police measures, which l may otherwise be necessary. Furthermore, it will set an l

example for other institutions in the solution of a pressing world-wide security problem, a matter which should be a source of pride' for the University and of personal l

satisfaction for you. ,
