licensee of Indian Point Station, Unit No.

2, hereby responds to New York State's Motion for Modification of Hearing Schedule (the "New York State Motion").

Con Edison takes no position with respect to the issues raised by the New York State Motion.

With respect to New York State's alternative request for additional hearing days, Con Edison submits that any party wishing,

to extend the overall length of the hearings such that testimony would not close on April 22 as currently provided by the Board bears a heavy burden of persuasion given the history of this proceeding to date.

We do not believe any such showing has been made here.

Since the State's Motion essentially relates to the sequencing of testimony within the presently allotted number of hearing days, it i's not necessary to add further hearing days to the schedule.
