Power Authority of the State of New York, licensee of Indian Point 3 Nuclear Power Plant (the " Power Authority")

hereby responds to New York State's Motion for Modification of Hearing Schedule (the "New York State Motion").

The Power Authority takes no position with respect to the issues raised by the New York State Motion. With respect to New York State's alternative request for additional hearing days, the Power Authority notes that since the State's Motion essentially relates to the scheduling of testimony within the presently allotted number of hearing days, it does not appear necessary to add further hearing days to the schedule.
