REQUEST FOR HEARING SUBMITTED WITH RESPECT TO THE LICENSE AMENDMENT APPLICATION OF FERMI 2, (DOCKET NO. 50-341-LA)

The Office of the Secretary received a petition to intervene and request for hearing in response to the license amendment application of FERMI 2, (Docket No. 50-341-LA), which was published in the Federal Register at 85 Fed. Reg. 728 (January 7, 2020). On March 9, 2020, Jessie Pauline Collins, on behalf of Citizens Resistance at Fermi 2 (CRAFT), incorrectly submitted this request via the General Submissions Portal of the Electronic Information Exchange (EIE). On March 11, 2020, the Document Processing Center alerted the Office of the Secretary (SECY) that this submission had been received through General Submissions instead of Adjudicatory Submissions and SECY staff reached out to Ms. Collins requesting a re-submittal through the adjudicatory portal. CRAFTs petition was re-submitted and received by SECY on March 11, 2020 via EIE.

The petition includes some discussion of the criteria and proposed NRC staff findings regarding a no significant hazards consideration determination. As stated at 10 C.F.R. § 50.58(b)(6), no petition or other request for review of, or hearing on, the staff's no significant hazards consideration determination will be entertained by the Commission. Accordingly, this referral memorandum is not to be construed as reflecting a determination that CRAFT is entitled to a review of, or hearing on, the staff's no significant hazards consideration determination.

The request and its supporting documents are located in ADAMS under package accession number ML20071G493 and are also available on the Electronic Hearing Docket.

The request for hearing is being referred to you for appropriate action in accordance with 10 C.F.R. § 2.346(i). This referral memorandum is being served on the E-Filing service list for the FERMI 2 proceeding, Docket No. 50-341-LA.
