20555 Perry Nuclear Power Plant Docket No. 50-440 Reactor Containment Building Integrated Leak Rate Test Results - Reassessment Gentlemen:

The Perry staff has reassessed the results of the Reactor Containment Building Integrated Leak Rate Test (ILRT) conducted during the mid-Cycle 4 maintenance outage, factoring in additional information regarding correction of test results. Based on this reassessment, the ILRT is no longer categorized as a failure. Hence, the next required ILRT will be performed in Refueling Outage 6, currently scheduled to begin in late 1997. Additional details are included blov.

On July 8, 1993 (letter PY-CEI/NRR-1664L), the results of the Reactor Containment Building Integrated Leak Rate Test (ILRT) for the Perry Nuclear Power Plant (PNPP) Unit 1 vere submitted for the test conducted during the mid-Cycle 4 maintenance outage. The ILRT was conducted in accordance with 10 CFR 50, Appendix J, Section III.A (Type A Tests).

The report categorized the ILRT as a failure based on adjustment of the Type j

A test results with the "as-found" data (i.e., test results obtained prior to repairs or adjustments of valves or flanges) from Type B and C penetration tests. This failure, in conjunction with the ILRT failure experienced in Refueling Outage 1, resulted in the ILRT schedule being accelerated in accordance with 10 CFR 50, Appendix J, Section III.A.6(b),

which requires an ILRT to be performed every refueling outage (or every 18 months) until two consecutive ILRTs meet the acceptance criteria.

Additional information regarding the determination of Type A test results had been provided in July 1989 by the Director of the Office of Nuclear Reactor Regulation (NRR). Correspondence dated July 27, 1989 (T. Murley (NRC) to H. Tucker (Duke Pover)) clarified that 10 CFR 50, Appendix J i

does not require licensees to correct Type A test results for certain Type B and C leakage (i.e., outside the period that the containment j

inspection for the ILRT is performed) to derive an "as-found" overall containment integrated leak rate. This clarification was not considered by PNPP staff for the evaluation of mid-Cycle 4 Type A testing.

NY-CEI/NRR-1860L February 3, 1995 Page 2 of 2 Considering the staff position as put forth in 1989 by the Director, NRR, the adjustment of the mid-Cycle 4 Type A test results with certain as-found Type B and C test results was overly conservative and not required to comply with 10 CFR 50, Appendix J.

Therefore, the PNPP ILRT performed during the mid-Cycle 4 maintenance outage is no longer considered to be a failed test. Based on the re-evaluation of test results from the mid-Cycle 4 outage, accelerated testing in accordance

. vith 10 CFR 50, Appendix J, Section III.A.6(b) is not required.

As well as providing positive confirmation of the acceptable performance of the containment structure, the successful results of the Refueling Outage 4 ILRT vill serve as the basis for scheduling future Type A tests in accordance with the applicable provisions of 10 CFR 50, Appendix J.

Accordingly, Type A testing vill not be performed during Refueling Outage 5.

The next Type A testing is planned to be performed in Refueling Outage 6, currently scheduled to begin in late 1997.
