MR. HOBBY has three (3) issues that have been brought to the attention of the NRC:
(1) He has filed a DOL complaint pursuant to Section 210. Energy Reorganization Act.
(2) In his DOL complaint he charges that GPC is in violation of their license conditions relative to their NRC approved organizational structure versus the actual operational reporttng lines of connunication as practiced by senior GPC management, l
(3) He contends that Mr. MCDONALD, Georgia Power's Exeecutive Vice President of Nuclear Operations, made false or misleading statements to NRC Comissioner Carr during the March 30, 1989, Cocaission hearing on plant Vogtle.
This alleged MFS was relative to the Commissioner's question pertaining to who Mr. MCDONALD actually reported to in the GPC organization ( Mr. DAHLBERG ).
He contends that while MCDONALD answered that it was DAHLBERG he actually reports to Mr. FARLEY of SONOPCO.

gDR ADOCK0500g4 Mr. HOBBY contends that in his then position as special assistant to the Vice President of GPC he was instructed in April 1989, by Mr. Fred Williams, V.P. of GPC's Bulk Power Markets, to write a memo detailing nuclear ills that have evolved as a" result organizational realignments with the creation of kN0PCO.

MARVIN B. HOBBY As a result of the contents of the " memo" WI.LIAMS ordered the destruction of all copies of said document.
He stated that the memo formalized concerns he had expressed v r.$ ally regarding problems with MCDONALD and his relationship with the SONOPCO arganization. The
" memo" at that point recieved limited distribution (either copy or verbally) to senior GPC and SONOPC0 management.
It was'nt until about Jan 1990, that he was approached by WILLIAMS and told to leave the organization on the terms and conditions imposed by GPC or a reorganization would be red as a pretext to force him out. This condition of uncertainty lasted urtil about Feb. 2,1990, when he was notified that his position had been eliminated. Additionally, lesser acts of retaliation have taken place such as removal from his work office, revocation of his parking permit and restriction from specified floors within the GPC building.
He contends that he is being removed from GPC in retaliation for having engaged in reporting deficiencies of a protected activity.
Mr. HOBBY maintains that PAT MCDONALD reports to JOE FARLEY of SONOPCO instead of MR. DAHLBERG of GPC, and that on page 33-35 of the transcript to the March '89, Comission hearing he lied to Comissioner CARR when questioned about who he reported to both by organization and by name.
CONTENTION:
(1) He is being fired for reporting to GPC mgm't. deficencies in the nuclear program resulting from fragmented mgm't caused by MCDONALD.
(2) GPC is in violation of their licence conditions regarding their actual reporting chain as compared to that approved by NRC.
(3) During the Comission hearings on V0GTLE, PAT MCDONALD lied to CARR relative i
to the GPC reporting chain (as practiced).
