Dear Administrative Judges:
So that no one will be taken by surprise, I am writing to inform you that on Monday, September 26, LILCO will file a motion to compel Suffolk County to provide more complete re-sponses to certain of LILCO's discovery requests.
We had planned to file the motion this week so that it might be taken up along with other discovery matters at the conference on Monday, but were unable to do so.
The motion will be hand-delivered to the Board and the parties on Monday morning prior to the conference.
We recognize that the Board may not want to take it up at the conference due to the timing of the filing, but we will be prepared to discuss the motion at the conference 3
if the Board wishes.
