, emergency plan. In response to this portion of the l

contention, the Applicants rely upon the arguments set forth

in their response to the contentions of South Hampton and Kensingtcn filed on September 21, 1983. As to the balance of the contentions, despite the fact that Pages 2-5 of the document purport to set out a basis for the contentions, in fact no sufficient factual basis is alleged.

, 9 The first full paragraph on Page 2 is simply a Jegal conclusion; the second argues about the issue of evacuation time estimates which has already been litigated; the third is an attack by Rye on Rye's own abilities; all of Page 3 and the top of Page 4 is a group of irrelevant assertions; (there is for example no requirement or need that medical services exist in Rye) and the balance in a group of irrelevant assertions as to the alleged motives of the Applicants and NRC and a statement of Rye's views as to what type of planning it will accept.

CONTENTION 2 Contention 2 in its entirety is an attempt to relitigate emergency action levels and evacuation time estimates which have already been litigated in the first phase of evidentiary hearings.

CONCLUSION Both contentions should be excluded.
