Gentlement In a Memorandum and Order of June 19, 1991, the Atomic Safety and Licensing Board-acknowledged receipt of copies of Ohio Edison Company's application to suspend the anti-trust license conditions of the Perry operating license, of which Ohio Edison is a co-owner licensee, insofar as they apply to Ohio Edison.

In that same Memorandum and Order, the Board directed Cleveland Electric Illuminating Company and Toledo Edison Com-pany, to supply the Board with copies of their application to 9100190060 910730 PDR ADDCK 05000440 '

July 30, 1991 Page 2 suspend as to them the same anti-trust license conditions of the Perry operating license and, additionally, the anti-trust licenso conditions of the Davis-Besse operating license.

Further, the Board directed the NRC Staff to provide it with copies of the Department of Justice's letter to the Commis-sion, dated June 13, 1990, and the Commission's letter to the Licenseos, dated April 24, 1991.

The City of Cleveland, a vital party to the anti-trust review proceedings that culminated in the issuance of the afore-mentioned Operating Licenses, and a vital party to the present phase of the proceedings initiated by Ohio Edison's application to suspend the anti-trust license conditions, believes that the Board should also have before it copies of the following filings made by the City of Cleveland in opposition to the applications:

1. Answer of City of Cleveland, Ohio, in opposition to Chio Edison Company's Application for Suspension of Perry Cperating License Anti-trust Conditions, dated February 19, 1988,
2. Comments of City of Cleveland, Ohio in Opposition to Application of Cleveland Electric Illuminating Company and the Toledo Edison Company for Suspension of Operat-ing License Ant.1-trust Conditions, dated September 13, 1908.
3. Letter dated Aug at 21, 1990, to Thomas E. Murley, Director, Office'#.bf Nuclear Reactor Regulation, from counsel for the Clty of Cleveland, Ohio, responding to a letter of July 24, 1990, from counsel for Ohio Edison Company to Mr. Murley.

These documents are incorporated by reference in the city of Cleveland'c " opposition to a Hearing with respect to the Denial of Applications to Suspend Anti-Trust License Conditions and Petition to Intervene in the Event Hearing is Requested and Granted" filed May 31, 1991, at pp. 7-8. These documents, inter Alla, present the City of Cleveland's arguments respecting the commission's lack of authority to grant the relief requested by
