Dear Judge Brenner:
This letter is to advise you that the City of Philadelphia did deliver its contentions to counsel for Philadelphia Electric Company, NRC Staff and LEA but not the Board, on September 1, 1983.
However, as a result of discussions between the Applicant and the City, during the period immediately preceding September 1, 1983, it was agreed on August 31, 1983 by the the City and the Applicant that attempted settlement of the issues rather than their immediate filing and litigation might be more fruitful.
Mr. Wetterhahn indicated, when this agreement was reached, that he would not oppose the City's subsequent filing of its contentions if the Board denied the joint motion for a one month extension.
Based on the City's interpretation of the September 2, 1983 Order, the City will file with the Board unresolved contentions along with a " good cause" discussion, if after discussion with LEA and PECO, any contentions cannot be resolved.
The intent of the City is to coordinate with LEA and to resolve with PECO and LEA as many contentions as possible prior to litigation.
