Nuclear Regulatory Commission Staff Action for Seventh Refueling Outage Gentlemen The Davis-Besse Nuclear power Station, Unit Number 1 (DBNpS) is presently scheduled to commence its seventh refueling outage (7RFO) nn September 1, 1991.
Modifications, inspections and tests are planned in addition to the refueling activities, which necessitate the amendment of certain Operating License, Appendix A, Technical Specifications and the Nuclear Regulatory Commission's (NRC's) approval of Non-Operating License (N-OL) requests.
The purpose of this letter is to alert the NRC Staff as to the amendments and approvals necessary in supporting the 7RFO.
To avoid an adverse impact on scheduled activities, Toledo Edison requests that the NRC Staff allocate the necessary resources to provide timely support for the review and issuance of these DBNPS license amendments and N-OL approvals.
Toledo Edison has reviewed its submitted and planned-to-be submitted License Amendment Requests (LARs). Amendment requests for the 7RF0 have been placed into one of two categories: A) " Required" Technical Specification amendments for the 7RF0, and B) " Desired" Technical Specification amendments for the 7RFO.
Attachments 1 through 2 identify the specific Technical Specification amendment requests within these categories.
Categories A (required amendments) and B (desired amendments) each provide a brief description of the change, the Technical Specification section affected and the planned or actual submittal date.
At present, Toledo Edison has identified two Category A (required) amendments.
These two amendments are in support of the refueling activities.
As previously discussed with the NRC Staff. Toledo Edison requests that the NRC Staff approve Toledo Edison's request (LAR 91-0011) to amend Technical Specification 5.3.1, Fuel Assemblies, prior to the 7RF0 to avoid the necessity of an exigtnt or emergency Technical Specification amendment.

Category B contains those amendments related to the 7RF0 for which issuance is desirable from the standpoint of minimizing radiological exposure, reducing outage duration, or improving plant operation.
For example, one amendment request (LAR 90-0049), when approved, vill allow for the elimination of potential radiological exposure resulting from unnecessary repairs due to an I
overly restrictive leakage criterion. The Category A and B amendment requests which are presently under Toledo Edison preparation are tentatively planned to be submitted to the NRC by the dates shovn in the attachments. identifies non-operating License approval requests for which Toledo Edison requests NRC action. The first request (Toledo Edison letter Ser.lal Number 1728) submitted in December, 1989, concerne the approval of an exemption request to allov use of a full-face respirator in lieu of a self contained breathing apparatus.
Similar exemptions have been previously approved for other plants. Toledo Edison plans to submit additional information requested by the NRC Staff by May 31, 1991.
The second request (Toledo Edison letter Serial Number 1916), was submitted on April 19, 1991 ard concerns Toledo Edison's plans for installation of a Safety Features Actuation System (SFAS) Shutdown Bypass for Operational Hodes 5 and 6.
This modification is designed to eliminate unnecessary SFAS actuations similar to those which have occurred during past refueling outages.
The third request concerns NRC approval of the initial post-refueling startup, if Toledo Edison reconstitutes any fuel assemblies during-the 7RFO.
This approval is linked to the NRC's approval of Toledo Edison's request (LAR 91-0011) to amend Technical Specification 5.3.1.
The fourth, fifth and sixth requests concern NRC approval of ASME Boiler and Pressure Vessel Code Section XI relief requeste for use during the 7RFO.
Toledo Edison believes.it has identified the Technical Specification amendments and N-OL approvals necessary for the 7RFO.
However, additional items may be identified as the 7RF0 approaches and as activities during the outage are completed.
Shoula additional amendments or N-OLs be identified, they vill be prepared and submitted as expeditiously as practical.
