Dear Mr. Denton:
Comments from individuals, groups and elected representatives on NRC's notice of a preliminary determination of no significant hazards consideration related to TMI-l's steam generator repair evince public interest in this subject. The comments reflect little understanding of the technical basis for the Staff's preliminary finding that the repairs meet the regulatory criteria for a deter-mination of no significant hazards consideration. Under these cir-cumstances, Licensee proposes that the NRC consider granting additional opportunity for public input after issuance of the Staf f's Safety Evaluation Report while allowing Licensee to proceed with pre-critical (non-nuclear) hot functional testing.
Several persons have requested a hearing on the amendment required to allow TMI-l to operate with repaired steam generators.
NRC must now make a final determination relative to significant hazards consideration. We anticipate based on the technical content of the comments received and on the results of Licensee's testing to date, that the final determination will af firm the Staf f's pre-liminary determination of no significant hazards consideration.
Thus, in accordance with the Sholly amendment and NRC's attendant regulations, NRC would be coligated to grant a hearing but could authorize the amendment without awaiting completion of the hearing.
Licensee proposes that the Commission consider the followi ng approach consistent both with its regulations and with the interest expressed through the public's comments :

Publish the Staff's Safety 2 valuation Report and make final its determination that the requested amendment of the TMI-l operating license involves no significant hazards con-sideration. The Commission would at that time also authorize Licensee to proceed with pre-critical (non-nuclear) hot functional testing in order to further test the repaired steam generators but woulo defer approval of operation with nuclear power.

Grant an additional opportunity for public comment on the Staf f's Safety Evaluation Report. Not only written com-ment for an additional period of 30 days, but as well, oral com-ment at a public meeting in the Harrisburg area could be allowed.
Such a meeting could be held midway through the comment period and could include a briefing by the NRC Staf f on its Safety Evaluation Report as well as public input. This public meeting would be in addition to any formal hearing subsequently held in accordance with the Sholly amendment.

Af ter receiving the results of Licensee's hot testing of the steam generators and af ter assuring that the technical considerations contained in additional public comments have been adequately considered in the evaluation report, grant final approval pursuant to the license amendment of the specific repair technique used. Nuclear operation of TMI-l with repaired steam generators would then be authorized contingent upon a f avorable Commission determination in the TMI-l restart proceeding.
Licensee understands that the approach outlined above is not contemplated by the Commission's regulations. We are confident, how -
ever, that hot functional testing will further confirm the adequacy
- of the repair and add to the public's confidence in restart of the unit. Moreove r, an opportunity for review and comment on the Staf f's Safety Evaluation Report and its detailed analyses should f urther add to the public's confidence in the technical / safety aspects of the repair and in the Commission's procedures for the approval of license amendments.
