Dear Sir:

Pursuant to Section 50.59 of the Commission's Rules and Regulations, j Vermont Yankee Nuclear Power Corporation hereby proposes the following l

modification to Appendix A of the Operating License.

PROPOSED CHANGE This change involves a revision to Page 206 of the Vermont Yankee Technical Specifications. The change deletes the Technical Specification provision for annual conduct of an exercise of our Emergency Plan. This provision is clearly governed by the requirements of 10CFR Part 50, Appendix E.

Eisenhut, Director Page 2 Management Agency (FEMA) and the States of Vermont, New Hampshire, and Massachusetts; have resulted in the tentative scheduling of the exercise during the week of September 19, 1983. Inalmuch as the date exceeds the provisions of 10CFR, Part 50, Appendix E ani Technical Specification 6.5 F.,

relief was requested in Reference (b). Reference (d) documents NRC's acceptance of our Exemption Request to 10CFR50, Appendix E; however, discuscions with our NRC Project Manager indicate that a separate licensing proposal would be necessary to obtain relief from the Technical Specification requirement. This change is intended to eliminate the need for revision of the Technical Specifications to support or supplement a request for exemption.

Because the requirements of 10CFR supercede / duplicate the provisdons of facility Technical Specifications, we propose to delete the Emergency Plan Exercise provision of our Technical Specifications. In addition to eliminating the need to seek approval for one-time changes to Technical Specifications, this change negates the potential for conflict between the requirements of 10CFR and the provisions of licensee Technical Specifications. This concern was expressed by the NRC in Generic Letter 82-23

SAFETY CONSIDERATIONS This proposed change is administrative in nature and has no safety or environmental significance. In addition, an exemption from the schedular requirements of 10CFR50, Appendix E, has been issued by the NRC via Reference (d).

This change has been determined not to involve a significant hazards consideration as defined in 10CFR50.92(c).

This proposed change has been reviewed by the VermoEt Yankee Nuclear Safety and Review Committee.

FEE DETERMINATION This change is pro forma, administrative in nature, and has no safety or environmental significance. For these reasons, Vermont Yankee Nuclear Power Corporation proposes this change as a Class II amendment, which requires a fee payment of $1,200 A check for the amount of $1,200 is enclosed.

l SCHEDULE FOR CHANGE The change will be incorporated into the Technical Specifications upon receipt of your approval. Based on the information contained within and in References (b) and (d), we are assuming that the NRC acknowledges and accepts the fact that the timeframe for conducting the annual exercise for this time period has been exceeded.
