Dear Mr. Chaiman:
This letter is in response to your recent le t tur r. q uc-s ting clarific ct ion of.an issue rel:..:2 to the Federal Emerr, cucy linnagement Agency's (Fel:A) review of of f site energency planning around the Indi an Point f acility in New York.
Specifically, you r.equested clarification cf enether or not, i n principle, a St.2te can substitute for a c. unty that does not have its own emergency pinn.
A State can choos e to of fset er substituto compens atory planning me asures in lieu of a local level emergency plan provided that they are developud for a specific local jurisdiction and are not t;eneric i n nature.
iioweve r,
without prejudgi ng any specific situation, it een be said that the planning and preparedness standards conta.ined in "NURCG-06 54-F :MA-iGP-1,' Rev.

voeld place a ve ry heavy resource burden on any State choo:.,i ng to :xe t
.oficite safety requirements in this way.

Fu r the rmo r e, a State co=pensato ry plan contradicts the i nt e rdependent f r amewo rk be twee n Ftate and local a,ovtzrnments upon which these joint FDIA/ Nuclear Ro.pilatory Coc:ission criteria arc based.
FD:A vi cvs this interdependence as c.ritieni to establishing atlequate of f site eme ry,ency. planning and prt paredness capability.
