This letter is in response to your recent le t tur r. q uc-s ting clarific ct ion of.an issue rel:..:2 to the Federal Emerr,cucy linnagement Agency's (Fel:A) review of of f site energency planning around the Indi an Point f acility in New York.

Specifically, you r.equested clarification cf enether or not, i n principle, a St.2te can substitute for a c. unty that does not have its own emergency pinn.

A State can choos e to of fset er substituto compens atory planning me asures in lieu of a local level emergency plan provided that they are developud for a specific local jurisdiction and are not t;eneric i n nature.
