Dear Administrative Judges:
During the February 15, 1983 hearing, this Board requested that Consumers Power Company search for and pro-vide, if found, records of communications between Messrs.
Cook, Marguglio, and Bird concerning the possibility of issuing a stop-work order'for the incident documented in Bechtel NCR 4199.
In addition, the Board requested written records concerning the decision whether or not to report the f
incidents documented in Bechtel NCRs 4199 and 4245 to the NRC.

correspondence, including records of oral communications, concerning MPQAD discussion as to the need for MPQAD to issue a stop-work order for the NCR 4199 incident prior to the issuance of FSW-22.
He found no such records.
In addition, he does not recall any such records ever having been written.
Benjamin Marguglio also does.not recall any discussions in this regard with either James Cook or Walter i
James Cook recalls a discussion between himself and Bird.
Walter Bird on the subject, the gist of which was that MPQAD should issue a stop-work to provide for a closed loop system to assure resolution prior to allowing work to proceed.

Administrative Judges April 5, 1983 Page Two With regard to records concerning the report-ability of the NCR 4199 ' incident, Walter Bird found no documentation as to reportability evaluations for this incident.
He does recall discussing the incident with Michael Schaeffer, MPQAD Electrical Section Head, at which time he received confirmation that the damage to the duct bank did not affect the electrical cables.
Finally, no records on the reportability of the NCR 4245 incident could be found other than what is covered in SCRE-51 which was introduced into evidence at the hear-ings.
