Gentlemen:

Millstone Nuclear Power Station, Unit No. 3 Proposed Revision to Technical Specifications Hydrogen Recombiners Reauest for Emeroency Authorization and Apr_qy_g.1 In a letter dated April 5, 1991 (Reference (1)), Northeast Nuclear Energy Company (NNECO), proposed to amend Operating License NPF-49 by revising the Millstone Unit No. 3 Technical Speciitcations regarding surveillance require-ments for the hydrogen recombiners.

In that letter, NNECO also requested that the NRC Staff process the above referenced license amendment request on an emergency basis in accordance with 10CFR50.91(a)(5).

The initial submittal (Reference (1)) had proposed to modify the surveiliance requirement, 4.6.4.2.b.4.

Specifically, the proposed change would have required that the 18-month functional test for the hydrogen recombiners be performed using containment air at a flow rate of at least 70 scfm at a containment pressure less than or equal to 15 psia and greater than or equal to 55'F.

However, based on a subsequent discussion with the NRC Staff on April 8,1991, NNEC0 hereby proposes the following change by adding a footnote to Technical Specification Figure 3.6-2.

The footnote to Figure 3.6-2 will read as follows:

Until September 30, 1991, a flow rate of 72.4 scfm or greater at a pressure of 14.5 to 14.8 psia is acceptable in lieu of the values indicated by Figure 3.6-2.

The revised Technical Specification page is provided in Attachment 1.

/ I should be noted that the significant hazards consideration discussion previ-ously included in the April 5,1991, letter is still applicable for the above change.

As discussed in Reference (1), this request involves no significant hazards consideration, and failure to act promptly would prevent start-up of the plant from the present refueling outage.

Alternatively, it is requested that a temporary waiver of compliance from Technical Specification Section 4.6.4.2.b 4 be granted until the Staff acts on the emergency amend-ment.

It is noted that the justification for emergency authorization and approval discussed in Reference (1) is still applicable for this request.

NNECO has concluded that it is appropriate and necessary that this license amendment request be processed on an emergency basis for the following rea-sons:

o The amendment request is needed to permit the start-up and continued operation of the plant.

o The license amendment does not constitute a significant hazards consider-

ation, o

NNEC0 made every effort to process this request in a timely manner to avoid this situation.

We also wish to emphasize our conclusion that this proposed amendment involves no undue safety risk nor irreversible environmental consequences.

We are therefore requesting this action to allow start up and continued operation of the plant, an action which is in the best interest of the health and safety of the public, our customers, and our shareholders, in accordance with 10CFR50.91(b), NNEC0 will provide the State of Connecticut with a copy of this request via electronic mail to ensure their awareness of this request.

We believe the above information provides a complete basis for approval of the requested amendment.

We will continue to keep you informed on matters rele-vant to this request, including the schedule for mode ascension and restart of the unit.

Should the Staff request any additional information to process this request, NNECO remains available to promptly provide such information.
