Please find enclosed a copy of a letter dated March 31, 1983, from Robert C. Arnold, President of GPU Nuclear Corpora-tion, to John F.
Stolz of the NRC Staf f, which withdraws Licensee's proposal of February 2, 1983 for an alternative to Licensee's commitment to install an ESF filter system for the fuel handling building at TMI-1.
This may obviate the need for the comments called for in the Appeal Board's Orders of February 17 and March 4, 1983.

Operating 1.icense No. OCR-50 Occket No. 50-289 Engineered-Safety-Feature (ESF) Filter System Our letter of February 2,1983 on the above subject proposed an alternative to our commitnant io Instal I an ESF fIIter system for the fuel handling building (FHB) at TMi-1.
The original comitment to Install the system was provided in cur Restart Report, found acceptable in the Staff's TH1-1 Restart SER (NUREG-0680), and was addressed by the ASLS in teele Partial Initial Decision (PID) oc " Plant Design Precedures en:: Separation issues" dated December 14, 1981.
Our proposed siternative to the E3F f ilter. system consisted of utilizing extended cecay time on TMI-t spent fuel to lioit of f site doses to within Standard Review Plan (SRP) guidelines in the event of a fuel handling accident on the Unit 1 side of the FHB.
The existing auxiliary & fuel handling building ventilation syste, while not fully ESF grade primarIiy due to seismic and 1E Power considerations. could be used to l
further reduce offsite doses to well below SRP guidelines.
The AL88 has requested that cerments on our proposal be fiIed by partles by AprIi 1,
1983.
I In our meeting with the Staf f and the Corurtonwealth of Pennsylvania on March '
25, we provided additional information to support our proposal, and we provided an overview of an analysis which shows that Instar tation of an ESF fIIter system wourd not be of significant benefit f rom an of f site dose consequences standpoint.
Staf f voiced objections to our proposal which we discussed further in a telephone conference call on March 29.
We were unable to reach an agreement on possible alternative approaches.

This reises the prospect of a re-cpened hearing.
While we have concludet i
that our proposal would.? set the technical requiretents of the Ccer.f ssion's reguistions, and we are confident that !!tigation of this issue would ultimately deronstrate its technical merits, we believe that the potential for fur ^ber delays in restart of TM1-1, due to a protracted hearing ;:rocess, would not serve the best interests of our electric customer s.
For this reason, we respectf ui ty witndrew our February 2,1983 proposal.
G!ven the timing of the situation, and our desire to provide adequate protection prior to the next ref ueling, we are preceeding with detsi t ed design work for an ESF f!!ter system in accordance with our original coann i tment.
