By my letter to you dated September 21, 1982, we submitted a request to change the technical specifications of the Browns Ferry Nuclear Plant unit 1 (TVA BFNP TS 177). That request proposed revisions to the unit 1 cycle 5 MCPR values because of an error discovered by General Electric in the active fuel length used in the original cycle 5 analysis.

We have since received NRC approval of license amendment request TVA BFNP TVA 184, by letter from R. J. Clark to H. G. Parris dated March 14, 1983 Approval of TS 184 has eliminated the need for approval of TS 177. This is because the page submitted by TS 177 was included in TS 184, and the TS 184 changes were based on the correct fuel length.

Operating cycle No. 5 of unit 1 is presently scheduled to end April 15, 1983 Aside from the impact of TS 184 explained above, the need for approval of TS 177 would have expired at the end of cycle 5.

Since being informed by GE of the incorrect fuel length, plant operation has been administrative 1y controlled to conservative limits. However, TS 177 was submitted to reinstate the conservatism into the technical specifications. Therefore, as TS 177 is no longer needed, we request that it be withdrawn from NRC staff review.

Class III fees totalling $4,000 were forwarded with TS 177 amendment request. Because TS 177 is no longer needed and because we have no evidence that NRC staff review was initiated, we request that the $4,000 be refunded to TVA.
