SETTLEMENT AGREEMENT 1

The undersigned party to the Callaway Operating License Proceeding (Emergency Planning Phase) agrees to the following disposition of Intervenor John Reed's Cottentions 4, 11, and 15:

e Reed Contention 4 (Emergency Action Level Scheme / Worker I.

I Notification).

A.

FEMA /NRC staff consnit to ensure, as part of their review of the off-site Radiological Emergency Response Plans for the Callaway facility, that:

1)

For each organization identified pursuant to Item A.1.a of NUREG-0654, the plans or procedures contain a listing of the individual (by title) and back-up (where appropriate) to be notified in the event of an emergency at the Callaway facility; 2)

Each such organization develops as a part of its procedures or otherwise, a list of its personael (with telephone numbers I

implement the organization's role in the emergency response.

B.

Based on the above commitment Mr. Reed agrees to withdraw his Contention Number 4.

C.

The Applicant interposes no objection to Paragraphs A and B above.

Li II. Reed Contention 11 (Standards For Reentry / Recovery).

A.

Applicant agrees to recommend that Annex L.Section II, Paragraph C.2 of the local Radiological Emergency Response Plans be amended to read as follows:

As a consequence of the incident, will not result in a projected total dose to members of the general population greater than 1 rem whole body and 5 rem thyroid over a period of 50 years (based on NRC Regulatory Guide 1.109 guidance on dose commitment period). These standards are the lower values of the State PAG ranges for the general population.

This guidance will be used until further specific guidance is developed by the appropriate federal agency.

B.

FEMA /NRC staff agree to review the local Radiological Emergency Response Plans to ensure that the dose standards for reentry / recovery include the time factor over which the dose will be measured.

C.

Based on the commitments in Paragraphs A and B, Mr. Reed l

agrees to withdraw his Contention Number 11.

III. Reed Contention 15 (Letters of Agreement)

A.

FEMA /NRC staff commit to ensure, as part of their review of the off-site Radiological Emergency Response Plans for the Callaway facility, that:

1)

Each organization that is relied upon to be a part of l

the emergency response effort is identified in the emergency plans pursuant to Item A.1.a of NUREG-0654; 2)

Where a letter of agrebment is required from an organization, the letter contains the following information:

a) the nature of the emergency services or resources to be provided.

b) the situation or conditions order which such services or resources will be provided.

G c) the letter is signed by an individual possessing the authority to comit the organization to the provision of the services or resources identified in the letter.

B.

Based on the above comitment, Mr. Reed agrees to withdraw his Contention Number 15.

C.

The Applicant interposes no objection to Paragraphs A and B above.

The undersigned party understands and accepts that this Agreement shall not become effective until signed l'y all parties (Intervenor John Reed, Applicant Union Electric Company, and the NRC staff) and until approved by the Licensing Board in this proceeding.
