Dear Mr. Wolfe:
Gary Groesch, spokesman for the Joint Intervenors in the licensing proceeding for Waterford 3 at Taft, Louisiana, has asked me to notify you that I have been chosen as co-counsel with Luke Fontana to aid the intervenors at future hearings. This in no way limits the right of Mr. Groesch to proceed without counsel .
This letter constitutes notification only, and will be followed up as you require with any other documents that are appropriate, that the Joint Intervenors wish to re-open Contention 22 regarding Waterford 3's cracked slab in the light of newly discovered evidence.
The cracks which were earlier ruled curable have reappeared and are now percolating water into the facility, which in. the opinion of our experts threatens the integrity of the reactor. Thus, we believe that another hearing is appropriate and necessary to deal with this new manifestation of an enduring and basic defect, both in the conception and in the execution of Waterford 3.
Please let me know, at your earliest convenience, what procedures you would like me to follow to re-open Contention 22.
