4 RESPONSE TO "AAMODT MOTIONS FOR PROVISION OF INFORMATION AND TO LIFT ORDER OF CONFIDENTIALITY OF REOPENED HEARING" In a motion filed on June 20, 1983, with the Atomic Safety and Licensing Appeal Board, the Aamodts request production of certain materials concerning proceedings before the Federal grand jury sitting in the Middle District of Pennsylvania.1!
The Nuclear Regulatory Commission has no authority to entertain that request.
Grand jury materials may be disclosed only by court order.

1! By separate pleading of the same date, we are responding on behalf of O, VV, and W to the Aamodts' Motion to lift the order governing confidentiality in this proceeding.

o f Together with the firm of Killian & Gephart in Harrisburg, Pa., we represent a large number of individuals who were employed at Three Mile Island Unit 2 on March 28, 1979.
(We do not represent General Public Utilities Corporation, GPU Nuclear Corporatidn~,
or Metropolitan Edison Company.)
Many of our clien'ts have testified before the March, 1983 grand jury br the '
.f May, 1980 grand jury in Harrisburg; others.are under subpoena to testify in the near future.
Wc.would vigorously. oppose any motion by the United States to disclose any grand jury materials that could adversely affect their interests.
The Aamodts state that the Department of Justice "is not opposed to a mot. ion to obtain this information".
We doubt that DOJ would thus, disregard its duty to protect the secrecy of grand jury
~
proceedings.
In any event, the position of DOJfis
.,av
- r immaterial, since only the United States Distribp Court
'c for the Middle District of Pennsylvania can author, ize j
any disclosure.
The Aamodts, in paragraphs 1, 3, and 9 of l
their motion, seek disclosure of various non-grand jury materials relating to the Hartman allegations.
