In accordance with the NRC's Safety Evaluation F m orts (SER's) for the IE Bulletin 79-01B and NUREG-0588 responses, Alabama Power Company has submitted a notification, dated February 16, 1983, that proprietary information was contained in the Technical Evaluation Reports (TER's).

Subsequent to receipt of the SER's, Alabama Power Company requested the appropriate yendors provide applications and affidavits for withholding specific TER infonnation from public disclosure. The level of detail necessary for protecting the information from public disclosure was requested to be consistent with the criteria in 10CFR2.790(b) of the Commission's regulations.

At this time, the vendors have not responded to Alabama Power Company's request. The rationale and justification for proprietary protection cannot be provided in accordance with the March 3,1983 schedule requested by the SER's. Alabama Power Company respectfully requests that all information of proprietary nature identified in the associated TER's be withheld from public disclosure until notified e

otherwi se. Upon receipt of the vendor information, applications and i

affidavits for proprietary protection will be submitted to the NRC with the level of specificity necessary for continued protection consistent with the criteria in 10CFR2.790(b) of the Comission's regulations.

It is expected that this information will be available by the 90 day submittal due date of May 12, 1983.
