Docket No. 50-289

Dear Appeal Board Members:

RE: Reopened TMI-l Restart Proceedings Immediate Consideration Requested The Union of Concerned Scientists has enclosed a motion request-ing deferral of all or part of the reopened evidentiary hearing in the TMI-1 restart proceeding. The motion is based on informa-tion received from the NRC Staff on March 2, 1983. As the motion explains, the new information is likely to alter the Staff's position with respect to the adequacy of the boiler-condenser to assure natural circulation. Even if the Staff's position does not change as a result of the Staff's yet unfinished evaluation, it is crucial to the Board's consideration of these issues. At a minimum, it will require supplementation of the prefiled testimony and the calling of additional witnesses, as well as the initiation of further discovery.

In light of this development, UCS believes that it would be wasteful to proceed next week. The particulars of our request 8303070139 830304 PDR ADOCK 05000289 Qbo3 J

Judge Gary J. Edles, Chairman Judge Reginald L. Gotchy Judge John H. Buck March 4, 1983 Page Two for deferral are stated in full in the motion. We request imme-diate consideration by the Board so that the parties can be noti-fled today, if at all possible, of any deferral of the hearing or of any other actions the Board may wish to take in light of the new information.

Sincerely, Ellyn . Weiss h pr' WN &
