Dear Sir:

Due to the phase out of the Price-Anderson indemnification, we request a prorated refund for each of the two units at Joseph M. Farley Nuclear Plant from the effective zero indemnification date of November 15, 1982 through the end of the term for which each indemnity fee was prepaid.

We are cognizant of the fact that a $1,000.00 fee assessment per l unit will be incurred with the elimination of the indemnity fee, attributable to Alabama Power Company's utilization of certified financial statements as a guarantee of payment of deferred premiums. We have prorated this assessment over the same periods for which we have 7 determined credit is due from prepaid indemnity fees.

Per letter of March 1,1982, Alabama Power Company submitted a check for $15,912.00 for the fee on license no. NPF-8 (Unit 2) for the period of March 18, 1982 through March 17, 1983. The refund amount to which we are entitled, after adjustment for the prorated $1,000.00 fee assessment, is $5,025.13.

We submitted another check for $15,912.00 per letter of July 6,1982 for the fee on license no. !!PF-2 (Unit 1) for the period of July 20, 1982 through July 19, 1983. The reic d amount to which we are entitled, after adjustment for the prorated 1,006.00 fee assessment, is $10,091.13.

A refund justification and calculations page is attached for your information.

November 15, 1982 through March 17, 1983 - 123 days 123 x 43.5945 = $5,362.12 credit ASSESSMENTS i A fee of $1000.00 per unit is assessed from those utilities who use certified financial statements as a guarantee of payment of deferred l premiums (10 CFR 140.7). We have not incurred this cost in the past because it is not assessed if a paid indemnity fee exceeds $1000.00.
