James G Keppler, Administrator Region III US Nuclear Regulatory Commission 799 Roosevelt Road Glen Ellyn, IL 60137 DOCKET 50-255 - LICEM E DPR PALISADES PLANT - RESPONSE TO IE INSPECTION REPORT 82-29 IE Inspection Report No 50-255/82-29 dated January 14, 1983 reported the results of a routine safety inspection conducted during December 1982.
Addressed in the report was one item of noncompliance to which a response is required. The item of noncompliance and response thereto are given below.
Item:
Technical Specification 3.9.4 requires that the liquid radioactive waste

discharge monitor be in operation during any release unless the monitor (RIA-1049) is down for maintenance.
If the monitor is down for maintenance, samples of the discharge water are required to be taken every four hours and each sample analyzed.
Contrary to the above, the provision for sampling every four hours has been used routinely to monitor and control liquid releases even though the discharge monitor was not down for maintenance. The monitor was l
simply declared inoperable.
Response
f Corrective Action Taken and Results Achieved The procedure used to control liquid releases (HP 6.4) implemented a previous NRC commitment to reduce allowable discharge rates for liquid releases based on monitor (RIA-1049) sensitivity. The method used in HP 6.4 was overly rik ictive, resulting in extremely low discharga rates.
The monitor was Q uefore declared inoperable, even though it was not down for maintenance, to facilitate higher discharge rates.

Personnel have been instructed to follow procedure HP6.4 as written, leaving RIA-1049 in an operable state unless tagged for maintenance repair. Therefore, subsequent to January 1, 1983, discharge monitor RIA-1049 has been operable with discharge rates limited by monitor sensitivity.
Corrective Action To Be Taken To Avoid Further Noncompliance Procedure HP6.4 vill be revised to reflect a more realistic allowable liquid discharge rate based on RIA-1049 sensitivity.
