Dear Chairman and Conmissioners:
We are taking the extraordinary liberty of addressing this letter.to you in response to the unusual letter of 1
February 23, 1983 from Mr. Cohalan, relating to the Shoreham l
Nuclear Power Station, Unit 1.
Mr. Cohalan 's conmunicat ion (which we view to be outside the normal processes provided for by the Rules of the Conmission) justifies the filing of this response with you.
We feel that the letter and its attachments I
should be striken from the records at the Conmission and f rom Docket No. 50-322(OL).
We do agree on the importance of swif t Conmission action to remove any uncertainities about the lawful conclusion of the hearings on the Shoreham Nuclear Power Station, Unit 1.
i However, there is presently pending before the Licensing Board j
a Motion to Terminate the Licensing Proceeding, and we are in oral argument this very day opposing the pending Motion for Certification of the termination issue to this Conmission, in order that the hearings may proceed to conclusion.
I Accordingly, we feel it inappropriate f or t he Conuni s s ion to take any action in this natter until it has the results of the l
Licensing Board's action on the pending Motions.
Finally, we note that Mr. Cohalan is apparently seeking l
l an ex pa r t e me e t i ng wi t h t he Conmi s s i on.
We would object to anyluch meeting with the members of the Conmission outside of the Commission's rules, and in which the Long Island Lighting I
l Company is not represented.
