3, hereby requests that the Licenses be amended by deleting Environmental Technical Specifications and their Bases contained in Appendix B of the Operating Licenses.

i are as follows:

A Peach Bottom License Amendment Application, submitted March 1, 1979, and amended November 29, 1982, relative to 10 CFR 50 Appendix I requested the inclusion in Appendix A of the Technical Specifications sections which essentially duplicate sections 4.3/5.3, 6.4 and 7.0 of Appendix B.
Therefore, it is requested that sections 4.3/5.3, 6.4 and 7.0 of Appendix B be deleted upon the effective date of the Appendix A changes requested by the License Amendment Application of March 1, 1979, and November 29, 1982.

Licensee has been advised that the Nuclear Regulatory Commission has taken the position that water quality related conditions in existing reactor operating licenses should be removed as a matter of law where the Licensee holds an effective National Pollutant Discharge Elimination System (NPDES) Permit.
Since Licensee is the holder of NPDES Permit No. PA0009733 for Peach Bottom Atomic Power Station, which provides for non-radiological water discharge limitations and monitoring requirements, it is requested that the requirements of Sections 2.1/3.1 and 2.2.4/3.2.4 be deleted.

During the construction phase and early operating life of the plant, it was important to monitor the effects of various environmental parameters in order to demonstrate their i
minimal impact on the local environm3nt.
For this reason, 1

sections 2.3/3.3 and 6.3.b were included in Appendix B of the Technical Specifications.
Sections 2.3/3.3 requires, in part that " Noise measurement will be made four times a year for the first year of one unit commercial operation and twice a year for the first year of two unit commercial operation."
This requirement has been met by the use of surveillance test ST 7.8.1, which was discontinued upon fulfillment of the i
requirement.
As sections 2.3/3.3 are obsolete it is appropriate to delete them.
i Section 6.3.b requires an annual visual inspection of the area of the discharge structure to reveal signs of erosion.
Each year Surveillance Test number ST 7.8.3 has been performed with no indication of erosion being demonstrated.
In consideration of the lack of findings it is believed that it would be appropriate to delete section 6.3.b at this time.

Section 6.2.a of Appendix B discusses a study to be made to determine an optimum chlorination program.
Such a study has i
been completed and submitted (W. B. Willsey, Philadelphia Electric Company to T. A.
Ippolito, US NRC, July 6, 1979).
This section is no longer applicable and should be deleted.
As this requirement has been completed, it is appropriate to delete section 6.2.a.

Daily monitoring of the area of the Conowingo Pond adjacent to the plant site to determine the presence of unusual or abnormal amounts of dead fish, oil, strange odors or unusual water color, or the absence thereof is accomplished via Surveillance Test S? 7.3.1 In consideration of the fact that there have been no occurrences in this category during the past seven years and since this requirement relates to water quality matters, for the reasons stated in paragraph 2 h'reof, it is requested that this requirement which is stated in section 4.2/S.2 of Appendix B, be deleted.
Licensee furthermore concludes, that due to the essential duplication of the Appendix B requirements and the fulfillment of original intent regarding monitoring of effects upon the environment, deletion of Appendix B of Facility Technical Specification will not have adverse impact on current level of environmental controls.

initiated amendment since the NRC staff has determined that it is a ministerial matter.

The Plant Operation Review Committee and the Operation and Safety Review Committee have reviewed these proposed changes to the Technical specifications, and have concluded that they do not involve an unreviewed safety question or a significant hazard consideration, will not endanger the health and safety of the public, and will not have an adverse environmental impact.
