Pursuant to 10 CFR S 2.749, the Applicants hereby move for summary disposition of contentions NECNP I.N.

This motion is grounded upon answers to interrogatories submitted by NECNP, NHAG and SAPL.

Pursuant to 10 CFR S 2.740 and this Board's orders, the Applicants submitted identical interrogatories to 8302100243 830207 PDR ADOCK 05000443 O

each of the admitted intervenors.

One of the interrogatories was:

"Does [name of intervenor] intend to litigate Contention NECNP I.N?"

Each of these three intervenors2 answered this interrogatory in the negative.2 This contention is, we therefore submit, effectively withdrawn and ripe for dismissal on summary disposition.

2NECNP's response was wholly unqualified.

SAPL and NHAG, while disclaiming the intention to offer direct evidence, each purported to reserve the right to cross-examine witnesses offered by other parties.

Neither has any standing to object to NECNP's effective withdrawal of the contention, however, since neither has the right to offer direct testimony on the contention.
