WNP-2 EMERGENCY PREPAREDNESS EXERCISE

Reference:

Letter from RH Engelken, NRC, Region V to RG Matlock, Supply System " Emergency Preparedness Exercises", dated December 14, 1982.

In response to the referenced letter, we expect to meet the requested dates for submittal of emergency preparedness information to Region V.

In addition, we will continue to coordinate the development of the exercise with NRC, FEMA, as well as State and local agencies.

We will also disseminate information on the scenario to these parties as appropriate, and in accordance with the provisions for secrecy agreed to by Mr. Vincent Everett of the Supply System and Mr. Ray Fish of your office.

We would like to take this opportunity to clarify one statement in l

the referenced letter.

Paragraph 1, states "In addition, a full scale l

exercise must be conducted before any new reactor facility license can be granted".

(Emphasis added)Dhis interpretation is not consistent with 10CFR50.47(d), which says in part "... no NRC or FEMA review, findings, or determinations concerning the state of offsite emergency preparedness or the adequacy of and capability tc implement State and local offsite emergency plans are required prior to issuance of an operating license authorizing only fuel loading and/or low power operations (up to 5% of the rated power)."

R. H. Engelken Page 2 January 17, 1983 Emergency Preparedness Exercise At present, it is still our intention to successfully conduct our emergency preparedness exercise on June 1, 1983. Our licensing goal continues to be receipt of a full power license in September 1983, (several weeks after the exercise).

If events develop to disrupt this schedule, e.g.,

all or a portion of the emergency preparedness exercise needs to be rescheduled or reperformed, i'c is our intention to request the issuance of a low power operating license, so that fuel load and low power testing can continue on schedule.

In such a circumstance, it is our understanding that 10CFR50.47(d) would allow the Commission to issue the low power operating license.

If you believe our interpretation of 10CFR50.47(d) is in error, please notify me immediately.
