STATUS REPORT OF APPLICANT COMMONWEALTH EDISON COMPANY In accordance with the Board's Order dated October 1, 1982 in the above captioned proceeding, Applicant, Commonwealth Edison Company, provides the following status report regarding its Braidwood Nuclear Power Station, Units 1 and 2.

The Byron /Braidwood Final Safety Analysis Report has been docketed with the Nuclear Regulatory Commission for some time. The Final Duplicate Design Approval issued by the Nuclear Regulatory Commission Staff on June 16, 1982 identified several Braidwood site specific issues which remain to be reviewed. It is the Applicant's understanding that the Braidwood Safety Evaluation Report is currently scheduled for issuance in December, 1983. The Applicant's Environmental Report was filed in 1978. An amendment necessary to supplement some of the data in that report is scheduled to be filed during the summer of 1983. The NRC Staff has scheduled a draft environmental statement for issuance in January, 1984. . The Company believes that it will submit whatever information is required on a timely basis to support the issuance of this document as well.

Braidwood Units 1 and 2 are presently scheduled for fuel load on April 30, 1985 and April 30, 1986, respectively.

These schedules have not been reviewed since last year but a detailed budget and schedule review is in progress. These dates will be either confirmed or revised in January, 1983. All.

schedules are based, of course, on the assumptions that revenues are maintained adequate to finance the construction and that work is not interrupted by strikes or the actions of other administrative agencies.

By letter dated September 30, 1982 Commonwealth Edison requested extension of the Braidwood Construction Permits. The present permit for Unit 1 expires on November 1, 1982.

This Board has admitted 7 contentions submitted by Neiner Farms for litigation in this proceeding and has deferred ruling on Contention Number 8 submitted by that intervenor.

Two contentions filed by Bridget Rorem, et al. were admitted for litigation. The Applicant plans to initiate discovery on

these contentions in the third quarter of 1983. The status of these contentions was determined from a review of the transcript of the initial prehearing conference held on August 29, 1979.

No prehearing conference order has been issued. Such an order should be issued within the next 6 months so as to confirm the status of each of the contentions and establish a date for the prehearing conference described below.

We believe that a prehearing conference early in 1984 at which time a discovery cutoff date would be established and a hearing date set, would be appropriate. We anticipate hearings in this proceeding in the summer of 1984 with an expectation that an initial decision would be issued by the Licensing Board by the end of that year. Assuming an initial decision authorizing the issuance of an operating license for the Braidwood units, such a schedule would permit adequate time for Commission review prior to the presently scheduled fuel load date.
