In the Matter of Application of Texas Utilities Generating Company, et al . for An Operating License for Comanche Peak Steam Electric Station Units #1 and #2 (CPSES)

Docket Nos. 50-445 and 50-446 Request for Subpoena for Dennis Culton As indicated in CASE's attached Motion to Allow Witnesses RegEding NRC's Investi-gation of Allegations of Whistleblowers, Dennis Culton is a very important witness which CASE wishes to call in the upcoming April 4-8 hearings.

Mr. Culton indicated to CASE this past week-end that he had spoken to his employer (who is paying for Mr. Culton's supplementary training in college and for whom Mr. Culton also works) regarding his testifying in the upcoming hearings. His employer has indicated that Mr. Culton will not be allowed to testify in the hearings, absent a subpoena.

Mr. Culton wishes to testify regarding this Inatter and has important information which the Board should hear. We therefore .equest that a subpoena be issued for Mr. Culton to appear Tuesday morning, April 5, at 9:00 A.M. This is in keeping with the 30ard's indication in yesterday's conference call that it would probably be through with its examination of Board witnesses regarding the Atchison-and-related matters in one day, Monday, April 4.
