Pursuant to 10 C.F.R.
S2.749, the State of Neu IIanpshire hereby 1
answers the Applicant's Fif th !!otion for Sunnary Disposition relating to Contention NH-9 on radioactivity nonitoring.
Contention 1
NH-9 was admitted into this proceeding by order of the Board dated September 13, 1982 as follous:
The Seabrook design does not provide an adequate progran for nonitoring the release of radioactivity to the plant and its environs, either under normal operating conditions.or in pre-and post-accident circunstances.
Thus, the Application is not in conpliance uith general design criteria 63 and 64 of Appendix A, 10 C.F.R. Part 50 and the requirenents of 11UREG-0737 and MUREG-0000.
In the valie of substantial discovery on this issue and design modifications in Amendnent 40 to the PSAR, New Hangshire no longer' asserts noncoupliance with GDC 63 and GDC 64, and focuses its attention nou only on NUREG-0737, Iten II.B.3, relating to post-accident nonitoring.
Regarding that G
l remaining issue, peu Hanpshire asserts that (a) because discovery is not complete on this issue sunnary disposition should be held in abeyance or (b) should the Board nahe a determination on this Sunnary Disposition Motion, it should be denied as to NUREG-0737, Iten II.B.3.
As of the date of this pleading, the Applicant has not provided details on its post-accident sampling capability in response to NH Interrogatory 9.14 (filed on October 15, 1982),
and it stated in response to NH Interrogatories 9.7 and 9.33 that a comparison of the Seabrook post-accident nonitoring system (PAHS) with the requirenents of Reg. Guide 1.97 has not been prepared.
Sinilarly, the Staff has been unable to respond to discovery requests on this issue, indicating that the Applicant has made no fornal subnission addressing NUREG-0737, Iten II.B.3.

Given this complete absence-of infornation on the PAMS, it is evident that the Motion for Sunnary Disposition as to this issue is prenature and should be held in abeyance.
Should the Board deternine, houever, that the Applicant's Fifth Motion for Sunnary Disposition is not prenature, Neu Hampsh. ire asserts that the Applicant has not yet produced sufficient infornation for the Board to conclude that the
