Pursuant to the Freedom of Information Act, 5 U.S.C.,

Section 552, as amended, and 10 C.F.R., Part 9, tne State of New Ilampshire requests the following documents concerning the.

quality assurance program:

DEFINITIONS (1) The term " document (s)" refers to the original and copy (but not both if identical in every respect) of any printed, written, recorded, transcribed, punched, taped, filmed, photographed, or graphic matter in the possession or subject to the control of the NRC or any Commissioner, employee, agent, or attorney thereof, whether sent or received or neither, whether a draft or otherwise, however produced or reproduced, and both sides thereof, including but not limited to, any memorandum, correspondence, letter, affidavit, court paper, transcript, diary, report, study, telegram, table, telex message, record, chart, paper, work paper, graph, index, book, notebook, pamphlet, periodical, tape, data sheet, data processing card, note, notation, minute desk calendar, appointment book, sound recording, computer print-out, or microfilm. 1 r212100102 821127 PDR FOIA pm KINDER 82-5p  ;

Director Office of Administration October 27, 1982 Page 2 (2) All references to "Public Service Company of New Hampshire, Inc." or "PSCO" herein shall include any officer, director, employee, agent, or attorney thereof.

DOCUMENTS REQUESTED (1) All documents which relate to an audit, assessment, review, or evaluation by the NRC or its contractors or agents of the performance of the PSCO and its contractors or agents of the quality assurance / quality control program required by 10 C.F.R., Part 50, Appendix B with respect to the design and construction of the Seabrook facilities (NRC Docket Nos.

50-443, 50-444).

(2) All correspondence between the NRC Staff and the PSCO, which relate to the performance of the quality assurance program of the Seabrook facilities.

(3) All documents prepared by the NRC resident inspector and/or the inspection staff which relate to the general quality of design or construction at the Seabrook facility and the trend of quality of design or construction at the facility.

(4) All documents which relate to an assessment, evaluation or review of the adverse effect of alcohol and drug use within the work force at the Seabrook f acility .cn1 the quality of design and construction.

(5) All documents which relate to an audit, assessment, evaluation, or review of the performance of United Engineers and Constructors, Inc. (Philadelphia, Pennsylvania) in the performance of its duties in providing engineering, design and procurement services and in directing construction of the plant by various subcontractors.

(6) All documents which compare the performance of PSCO and United Engineers and Constructors, Inc. in relation to the requirements of 10 C.F.R., Part 50, Appendix B, Quality Assurance Criteria, with the performance of owners, architects, and construction managers at other nuclear power plant facilities.

(7) All documents which have been prepared to establish and confirm compliance of the Seabrook Quality Assurance Program with Criteria 16 (corrective action) of 10 C.F.R., Part 50, Appendix B.

Director Office of Administration October 27, 1982 Page 3 (8) All or review documents which relate to an assessment of the adverse effect of the size of the wo, evaluation rk force at Seabrook on the quality of design and construction at the Seabrook facility.

(9) All documents which relate to the consideration by NRC of performing any assessment, audit, review, or evaluation of the Seabrook Quality Assurance Program for design and construction which could in any way be considered to be beyond or in addition to normal inspection procedures.

The New Hampshire Attorney General is a participant in the NRC Operating License Proceedings for the Seabrook Nuclear Facility and has an immediate interest in obtaining all available information which relates to the health and safety of the citizens of New Hampshire. Because the above information can be considered primarily as benefiting the general public, it is our opinion that it would be appropriate in this case for the NRC to waive copying charges pursuant to 5 U.S.C., Section 552(a)(4)(A) and 10 C.F.R., 9.14(a).

We understand that, under the Freedom of Information Act, you must respond to this request within ten (10) working days and that your failure to respond within that period of time is considered to be a denial of the request. Please notify me immediately if you cannot or will not respond within that time period. Thank you for your assistance in this matter.
