NOTICE OF EXEMPTION The Nuclear Regulatory Commission (the Commission) has granted an Exemption to The Toledo Edison Company and The Cleveland Electric Illuminating Company (the licensees) for the Davis-Besse Nuclear Power Station, Unit 1 (located in Ottawa County, Ohio), from the following technical requirements set forth in Section III.G of Appendix R to 10 CFR 50:
(1) the requirement for a fixed fire suppression system in the control room, and (2) the requirement for one hour-rated fire barriers where less than 20 feet of separation exists between redundant trains of equipment in the component cooling water heat exchanger and pump room. The'.Exenption is effective as l
of its date of issuance.

In granting the Exemption, the Commission determined that it is authorized by law and will not endanger life or property or the common defense and security, and is otherwise in the public interest. The Commission also detennined that granting the Exemption will not result in any significant environmental impact and that pursuant to 10 CFR 551.5(d)(4) an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of this action.
