We understand that on November 22 the Board will hear argument only on the motions to strike or for summary judgment and the Board's proposal for evidentiary depositions.

Because only the latter issue engages the attention of NSC and because the enclosed memorandum says all we have to say on that subject, we hereby advise the Board that NSC will waive its right to participate in the hearing and is content to rely on the enclosed memorandum.
