Johnson will be away from the United States on business from November 10-21, 1982, and thus will be unavailable for cross-examination during the November 16-19, 1982 portion of the LWA-1 evidentiary hearing. Intervenors hereby request permission to defer cross-examination of Dr. Johnson until the December 13-17 portion of the LWA-1 hearings. Dr. Johnson's prefiled written testimony will be filed on November 1, 1982 and supplemented, if necessary, by November 12, 1982, in accordance with the Board's Scheduling Order of August 31, 1982.

Intervenors were unable to confirm Dr. Johnson's availability as a witness until after the close of discovery on October 18, 1981. Intervenors note, however, that despite requests by Intervenors, Applicants have not identified any of the witnesses they intend to have testify during the next phase of the evidentiary hearing. Intervenors have no objection to a reopening of the discovery period until November 1, 1982 for purposes of deposing Dr. Johnson and Applicants' witnesses, on the condition that Applicants witnesses, identified for the first time on October 18, 1982, will also be made available for deposition during that period.
