Docket Nos. 50-259 Tennessee Valley Authority

)

50-250 50-296 BROWNS FERRY NUCLEAR PLANT (BFN) - UNITS 1, 2, 3 - DETERMINATION OF NONREPORTABILITY The purpose of this letter is tot

1) retract a four-hour non-emergency notification,'and 2) modify the way TVA will retract notifications in the future.

On September 26.-1990,'a"four-hour non-emergency notification was made to the NRC in accordance with 10 CFR 50.72(b)(2)(i).. A subsequent review

. determined that conditions were not reportable under 10 CFR 50.72 or 50.73. This.was reported by telephone on-October 23, 1990.

This letter satisfies TVAs ^ commitment to retract in writing 10 CFR 50.72' s

= notifications.that-do not require a 10 CFR.50.73-Licensee Event Report (LER).- That-commitment was made,in TVA's letter dated September 21, l

1989. However, on June 20, 1990 NRC stated at the LER workshop held'at King of. Prussia', Pennsylvania that 10 CFR 50.72 notifications should be retracted by telephone, rather than.in writing, which will also serve to 1

clarify the record correlating 10 CFR 50.72 notifications with 10 CFR 50.73 LERS.

Consequently, TVA will retract future unnecessary 10 CFR f

.50.72 notifications: that do not require a 10 CFR 50.73 LER by telephone, rather than:-in writing. The enclosure contains a sumary of the m

' commitments made-in-this letter.
