Amer.dment No. 209-License No. DPR-59 1.

The Nuclear Regulatory Comission (the Commission) has found that:

A.

The application for amendment by Power Authority of the State of New York (the licensee) dated December 28, 1993, complies with the standards and requirements of the Atomic Energy ~ Act of 1954, as amended (the Act) and the Comission's rules and regulations set forth in 10 CFR Chapter I; 8.

The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Comission; C.

There is_ reasonable assurance (1) that the activities authorized i

by this amendment can be conducted without endangering the health and-safety of the public, and.(ii) that such activities will be conducted in compliance with the Comission's' regulations; D.

The issuance of this amendment will not be inimical to the comon defense and security or to the health and safety of the public; and E.

The issuance of.this amendment is in accordance with 10 CFR Part 51 of the Comission's regulations and all applicable requirements have been satisfied.

2.

Accordingly, the license is amended by changes to the Technical-Specifications as. indicated in the attachment to this license amendment, and paragraph 2.C.(2) of Facility Operating License No. DPR-59 is hereby:

a (2) Technical Scecifj_qations The Technical Specifications contained in Appendices A and 8, as revised through Amendment No. 209, are hereby incorporated in tha license. The licensee shall operate the facility in accordance with the Technical Specifications.

3.

This license amendment is effective as of the date of its issuance to le implemented within 30 days.

If the requirements of 3.5.D.1 cannot be met, the reactor 2.

When it is determined that one valve of the ADS is inoperable, the ADS subsystem actuation logic for the operable ADS valves aid the HPCI subsystem-shall be verified to be operable immediately and at least weekly thereafter.

b.

When it is determined that more than one relief / safety valve of the ADS is inoperable, the HPCI System shall be verified to be operable immediately.

3.

Low power physics testing and reactor operator training shall be permitted with inoperable components as specified in 3.5.1.a and 3.5.1.b above, provided that reactor coolant temperature is 5212'F and the reactor vessel is vented or reactor vessel head is removed.

4.

The ADS is not required to be operable during hydrostatic pressure and leakage testing with reactor coolant l

temperatures below 3OO*F and irradiated fuel in the reactor vessel provided all control rods are inserted.
